Eligibility: The Computershare Investor Services ("Computershare") Nespresso Vertuo Next Coffee Machine giveaway (the "Giveaway") is open only to individuals who are legal residents of the provinces and territories of Canada (excluding Quebec) who have reached the age of majority in their jurisdiction of residence at the time of entry, and who receive an email invitation from Computershare to complete the Global Tax and Compliance Survey 2022 ("Survey"). Employees of Computershare, those involved in the production, development, implementation or handling of the Giveaway, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, any other person or entity associated with the Giveaway (collectively the "Giveaway Entities") and/or the immediate family (spouse, parents, siblings and children) and household members (whether related or not) of each such employee, are not eligible. All Canadian, federal, provincial and local laws and regulations apply to the Giveaway.
The Giveaway is not open to residents of Quebec and where prohibited by law.
Agreement to Official Rules: By completing the Client Survey and selecting to enter the Giveaway to win a Nespresso Vertuo Next Coffee Machine, you agree to be bound by the following rules, which constitute a binding agreement between you, on one hand, and Computershare on the other (the "Official Rules"). These Official Rules apply only to the Giveaway and not to any other giveaway or contest sponsored by Computershare. Computershare reserves the right to cancel or amend the Giveaway or these Official Rules at any time without prior notice.
Entry Period: The Giveaway begins at 8:00 am (EST) on Wednesday, January 26th, 2022, and ends at 11:59 pm (EST) on Friday, February 18th, 2022 (the "Entry Period"). Entries received prior to or after the Entry Period will not be accepted.
Entry: During the Entry Period, go to the Global Tax and Compliance Survey 2022 and follow the instructions to submit your entry. This will qualify you for one entry to the Giveaway. You can only qualify for ONE (1) entry in the Giveaway. Any individual user may use only one (1) email address to enter the Giveaway. Multiple entries are not allowed and will be void. The use of any agencies or automated software to submit entries will void all entries submitted by that person. No purchase is required in order to enter the Giveaway.
Drawing: On or about Friday, March 4th, 2022, Computershare will select the name of one (1) potential winner in a random drawing of all eligible entries received during the Entry Period. The odds of being selected as the potential winner depend on the number of eligible entries received during the Entry Period. The selected entrant will be contacted via the e-mail address provided at the time of entry. Before being declared the winner, the selected entrant will be required to correctly answer a time-limited mathematical skill testing question to be administered by email. If a winner is unable to be contacted within 5 business days of being selected (i.e. draw date), is ineligible, or the Skill testing question is not answered correctly, their prize will be forfeited and a new potential winner will be drawn from the remaining eligible entries in the Giveaway.
Prize: There is one (1) Nespresso Vertuo Next Coffee Machine available to be won, with an approximate retail value of $209 CAD before any applicable taxes. No cash or other substitution may be made, except by Computershare, who reserves the right to substitute the prize with another prize of equal or greater value if the prize is not available for any reason as determined by Computershare in its sole discretion. A Computershare representative will contact the winner to organize the delivery of the prize. The winner is responsible for any taxes and fees associated with receipt or use of the prize. Mailed prizes will not be insured and Computershare assumes no liability for lost, damaged or misdirected prizes.
Privacy: The name of the Giveaway winner will not be published by Computershare in any periodical, website, or other medium to the general public. The eligible winner will be notified by e-mail. Computershare will not disclose or utilize the data provided by entrants in connection with the Giveaway for any purpose other than to administer the Giveaway in accordance with the Official Rules.
General Conditions: In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Computershare may, in its sole discretion, either: (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. Computershare reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of the Official Rules or in a disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Computershare reserves the right to seek damages from any such person to the fullest extent permitted by law. Computershare's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In case of a dispute as to the owner of an entry, entry will be deemed to have been submitted by the natural person who logs on to the Global Tax and Compliance Survey 2022, selects the link, completes the survey, provides his/her name and email address and selects to participate in the Giveaway.
Release and Limitations of Liability: By participating in the Giveaway, entrant agrees to release and hold harmless the Giveaway Entities from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use or misuse of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Giveaway or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt or use or misuse of any prize. Entrant further agrees that in any cause of action, the Giveaway Entities' liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Giveaway Entities be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. The Giveaway Entities neither make, nor assume any responsibility for, any warranty, representation or guarantee with respect to the products offered under the Giveaway.
Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Province of Ontario. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, entrant's rights and obligations, or the rights and obligations of Computershare in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
